Important notice

Please read these Terms & Conditions carefully before using the WhatToday platform. By accessing or using our platform, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use the platform.

WhatToday is a booking intermediary. The contract for the activity is between you and the provider. WhatToday is not the organizer or operator of any activity.

1. Who we are

WhatToday operates an online marketplace that connects tourists with independent local activity and experience providers in Mallorca and beyond.

2. Role of WhatToday – intermediary only

WhatToday acts exclusively as a booking intermediary, marketing platform and payment collection agent on behalf of independent third-party service providers.

WhatToday is NOT:

  • the organizer of any activity, excursion or experience
  • the operator of any vessel, vehicle or equipment
  • a travel agency or tour operator under EU Directive 2015/2302
  • responsible for the delivery, quality or safety of any listed service

The legal contract for any booked service is entered into directly between you (the customer) and the respective provider. The provider name is clearly indicated on each booking confirmation.

EU Package Travel Directive (2015/2302): WhatToday does not combine services into package holidays. Each booking is a standalone service contract between you and the provider.

3. Booking process

A booking is confirmed once:

  • payment has been successfully processed by WhatToday
  • a booking confirmation has been sent to your email address

You are responsible for:

  • providing accurate personal information during booking
  • ensuring you meet all participation requirements before booking
  • reading the activity description and any restrictions prior to purchase

Booking confirmations are sent by email. Please check your spam folder if not received within 15 minutes.

4. Prices and payments

All prices are displayed in Euros (EUR) and include applicable taxes unless otherwise stated.

Payment is collected by WhatToday on behalf of the service provider using secure third-party payment processors (Stripe). By completing a booking, you authorize WhatToday to charge the displayed amount to your selected payment method.

WhatToday may display promotional prices, last-minute discounts or special offers. These prices are set by providers and subject to availability.

5. Cancellation & refund policy

5.1 Cancellation by customer

More than 24 hours before scheduled start time:

  • Full refund to original payment method within 5–10 business days

Less than 24 hours before scheduled start time:

  • No refund is available
  • This applies regardless of reason, including personal emergencies, illness, travel disruptions or flight delays

We strongly recommend purchasing personal travel insurance that covers activity cancellations.

5.2 No-show and late arrival

Customers must arrive at the meeting point at least 15 minutes before the scheduled start time unless otherwise specified by the provider.

  • Late arrivals may be refused participation at the provider's discretion
  • No refund shall be issued for no-shows or late arrivals
  • WhatToday is not liable for costs arising from missed departures

5.3 Cancellation by provider – weather or safety

Where a provider cancels due to weather conditions, unsafe sea or wind conditions, force majeure, government restrictions or safety concerns, you will receive:

  • a full refund to your original payment method, OR
  • an alternative booking date at the same price, if available

The decision regarding whether conditions are safe to operate rests solely with the provider. WhatToday does not override provider safety decisions.

5.4 Cancellation by provider – other reasons

If a provider cancels for operational reasons not related to weather or safety, you will receive a full refund. WhatToday will attempt to offer an alternative where possible.

6. Participation requirements

You are solely responsible for ensuring you meet all stated participation requirements before booking, including:

  • minimum age requirements
  • health and fitness conditions
  • swimming ability for water activities
  • valid driving license for vehicle rentals or buggy tours
  • sobriety — providers may refuse participation to intoxicated persons
  • compliance with all safety instructions

No refund shall be issued where a provider refuses participation because a customer fails to meet stated requirements or violates safety instructions.

7. Liability limitations

To the maximum extent permitted by applicable law:

  • WhatToday is not liable for personal injury, death, loss or damage arising from provider services
  • WhatToday is not liable for provider cancellations, delays or service quality issues
  • WhatToday is not liable for weather-related disruptions or force majeure events
  • WhatToday is not liable for loss of personal belongings during activities

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Spanish or EU consumer law, including rights under Real Decreto Legislativo 1/2007 (Spanish Consumer Protection Law).

Your statutory rights as an EU consumer are not affected by these Terms.

8. DSA – Digital Services Act compliance

WhatToday operates in compliance with Regulation (EU) 2022/2065 (Digital Services Act).

As a marketplace, WhatToday:

  • displays the identity of each provider on their listing and booking confirmation
  • does not guarantee or verify the accuracy of all provider-submitted content
  • provides a complaints mechanism for users (see Section 12)
  • maintains a notice-and-action system for illegal content reports

Provider listings may contain information supplied by the provider. WhatToday is not responsible for the accuracy of provider-submitted content but will investigate and remove content reported as illegal or misleading.

9. Intellectual property

All platform content including the WhatToday name, logo, trademarks, design, software and text is the exclusive property of Global Network 4 You S.L. or its licensors.

No content may be copied, reproduced, distributed or used commercially without prior written consent.

10. Privacy

Your personal data is processed in accordance with our Privacy Policy, available at www.whattoday.app/privacy. By using the platform you acknowledge and accept such processing. WhatToday complies with Regulation (EU) 2016/679 (GDPR).

11. Reviews

Customers may submit reviews following completed bookings. By submitting a review you confirm that:

  • the review reflects your genuine experience
  • the content is accurate and not defamatory
  • you are not affiliated with the provider being reviewed

WhatToday reserves the right to remove reviews that are false, abusive, defamatory, discriminatory or otherwise in breach of these Terms.

12. Complaints and dispute resolution

We aim to respond within 5 business days.

If your complaint relates to a provider, we will forward it to the relevant provider and facilitate resolution. WhatToday is not obligated to compensate for provider failures but may do so at its discretion in exceptional circumstances.

13. Governing law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Palma de Mallorca, without prejudice to mandatory consumer protection rights under the law of your country of residence.

14. Amendments

WhatToday reserves the right to update these Terms at any time. Material changes will be communicated by email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.
